Question 1

What should I consider when my tenants move in?

Accepted Answer

Before the tenants move in, you should check that the apartment is in perfect condition. The apartment should be thoroughly cleaned before your tenants move in. Make sure that the furniture and electronic devices do not have any defects and that the Wi-Fi works. You can check that the equipment in the apartment is complete using the inventory list. Replace missing items if necessary.  When handing over the apartment, you should check in which condition the apartment is and document any existing damages in a handover protocol. We recommend taking photos of the furniture and electrical appliances when moving in. You and the tenant should send these pictures to each other by email to record the date on which the pictures were taken.  This way, any damage that occurs during the tenancy can be identified during the handover of the apartment when your tenants move out. The cost for the damage can then be offset directly against the security deposit. What should I consider when my tenants move out?

Accepted Answer

When your tenants move out, the apartment should be handed over in a well-swept condition. With the help of the handover protocol signed when your tenants moved in, you can check whether any damage has occurred during the tenancy. Document this in another handover protocol. Compare the inventory list to see if the equipment in the apartment is complete. Also make sure that all keys are returned. Damage and missing items can usually be offset against the deposit.  Especially if there is little time between the change of tenants, it is a good idea to carry out a preliminary inspection some time before the tenants move out. In this way, you can clarify possible maintenance needs at an early stage, and any existing damage can be repaired before the new tenants move in. Question 3

Where can I find the rental agreement?

Once the booking is complete and the rental agreement signed, you will find the rental agreement in your account in the dashboard.      First, click on "Bookings" under the relevant listing. Then select the desired tenant from the list. By clicking on the name of the tenant, you will receive all information about this tenancy, and you can view and download the rental agreement.

Question 4

What happens if the tenant no longer wishes to move into the rented apartment?

Accepted Answer

Both you and the tenant can cancel the booking process at any time before the booking has been completed.      In Germany, the following applies: After a rental agreement has been signed, the law does not provide for early termination in the case of fixed-term rental agreements, though. In exceptional cases extraordinary termination is possible, for example, if the tenant is denied access to the apartment or is not granted access in time, or if there is a considerable health hazard in the apartment.      You have the option of coming to an individual agreement with your tenant on an early termination of the tenancy. We will be happy to help you draw up a termination agreement and seamlessly find a new tenant for your apartment. We will refund the overpaid service fee in the event of an early move-out if we have received confirmation that the tenancy has been terminated.     Do you rent out the apartment commercially?   In Germany, the following applies:  your tenants, as private individuals, have a 14-day right to revoke the contract, if the apartment was not viewed before signing the rental contract and the rental contract was concluded online.    Please note: This does not constitute legal advice – the information on this page has been prepared solely for your information. Can the tenant move out before the end of the rental agreement?

In the case of fixed-term rental agreements, the law does not provide for early termination. In exceptional cases, extraordinary termination is possible, for example, the tenant is denied access to the flat or is not granted access in time, or if there is a considerable health hazard in the apartment.     You have the option of coming to an individual agreement with your tenant on an early termination of the tenancy. We will be happy to help you draw up a termination agreement and seamlessly find a new tenant for your flat.      We will refund the service fee overpaid in the event of an early move-out if we have received confirmation that the tenancy has been terminated.      You rent out the apartment commercially?   Then your tenants, as private individuals, have a 14-day right to revoke the contract. Question 6

Where can I find the contact details of the tenant of my apartment?

Accepted Answer

As soon as the booking is completed and the rental agreement has been signed, you will find the tenant’s contact details in your account in the dashboard. First click on "Bookings" under the respective listing. Then select the desired tenant from the list. By clicking on the tenant’s name, you will see all information about this tenancy, including the tenant's telephone number and email address.

Question 7

What happens in case of loss of rent?

Accepted Answer

Your tenants enter into a tenancy agreement with you and are therefore obliged to correctly pay the rent to you.      At your request, we will gladly remind your tenants of outstanding rental payments and contact them personally. However, Wunderflats is not a party to the rental agreement. If you do not receive the rent even after several requests for payment from you and from us, we recommend a dunning procedure. We will gladly provide you with the necessary information for this procedure.

Question 8

Do you verify the tenants?

Accepted Answer

As it is usual on the regular rental market, we check the identity and solvency of all tenants.      In any case, we need a current address and a valid government-issued identity document from each person moving in. We also need proof of the tenant's solvency (for example, the employment contract or current pay slips).

Question 9

Should I issue a confirmation of residence (Wohnungsgeberbestätigung) to my tenants?

Accepted Answer

According to the German Federal Act on Registration landlords are required to support the official registration of their tenants and issue them with a confirmation of residence (§19 BMG). The tenant submits this confirmation when registering an address (Anmeldung) or changing the place of residence at the registration office (Einwohnermeldeamt) or the citizens' office (Bürgeramt or Bürgerbüro).    Please download our template for the confirmation of residence (Wohnungsgeberbestätigung). The confirmation can also be issued informally; it must contain the following information:     Name and address of the landlord/-lady and, if they are not the owner, the name of the owner of the apartment    Date the tenant moves in    Address of the rented apartment    Names of all persons moving into the apartment    Signature of the landlord     An exception is made if the rented apartment is in an accommodation facility (for example, in an apartment hotel). Question 10

Does the tenant need liability insurance?

Liability insurance is not obligatory for tenants. However, we recommend that tenants take out liability insurance to be covered in the event of damage.
